The items outlined in the below terms and conditions apply to all occupants (“you”,”your”) who stay at any property managed by Beachside Breaks Pty Ltd (ABN 16607770847), trading as Beachside Breaks (“we”,”us”,”our”). It is your responsibility to have read and understand these terms and conditions before a booking is made. You as the primary guest must ensure that all of your party and any visitors comply with these terms and conditions, including any house rules and strata by-laws made publically available on the property. Non compliance of these terms and conditions will be considered a non compliance by you. Failure to comply with these terms and conditions may result in (but not limited to), you being evicted from the property, full or partial loss of your security bond and any other monies paid or owed by you. Payment for a booking with Beachside Breaks constitutes agreement of these terms and conditions.
We require a 50% deposit within 48 hours to secure bookings. Payment is accepted with Visa, MasterCard or Amex. Credit card payment is subject to a credit card merchant fee. The remaining funds are due at least 30 days prior to arrival. If payments is not received by the outlined due dates, we reserve the rights to cancel the booking according to our cancellation policy. If payment is made by bank transfer, we must be notified of the time, date and receipt number of the transaction. The booking reference number must be used as a description when making payment by bank transfer. We are not responsible for any bank charges, transaction fees or charges. We are unable to provide access to the property until we have received the full amount for the entire duration of the stay unless alternative arrangements have been communicated and agreed in writing by Beachside Breaks.
If a guest requires a cancellation, the following applies. 50% deposit returned if cancellation is notice is given more than 30 days from arrival. There will be no cancellations within 30 days from arrival. If the booking was made through a 3rd party website which does not allow for our cancellation policy, the cancellation policy of that website shall apply.
When booking through Beachside Breaks, you will be required to furnish us with a refundable damage deposit for including but not limited to any guest requested charges that are incurred, incidental expenses, damage incurred during your stay, excess cleaning requirements, and penalties for breaching these terms and conditions. This is taken in the form of a credit card transaction, and be taken from the card the booking was made with, the transaction can take up to 2 weeks to be released after departure. The duration is at your bank’s discretion. The amount will be specified at the time of booking.
Check in & out
Checks in hours are between 2pm and 6pm, Monday to Saturday. Special arrangements are possible outside of these hours. If requested, a concierge from Beachside Breaks will personally welcome you at the property and provide keys and walk you around the property. The concierge will wait for 30 minutes after the pre-arranged arrival time, after which arrangements for key pick up may be made. If a personal check in is not possible, we will organise for a lock box to be left at the property for you and send through access instructions Check out time is 11am unless otherwise agreed in writing, the property must be vacated by this time, If the guest refuses to leave by the agreed check out time, this will be considered an act of trespassing and we reserve the right to contact the authorities to have the guest removed forcefully. A penalty fee will be taken from your bond if the property is not vacated by the agreed time. Your concierge will explain what do to with keys upon departure, procedures can also be found in the house manual. If the keys are not returned on check out or lost at any time during your stay, we reserve the right to charge the replacement cost per set of keys. This amount will be taken from your security deposit and the cost of replacing and security fobs and/or garage remotes. Guests are responsible for the return of keys if they are taken accidentally at the time of check out. If keys are not returned within the agreed time, we reserve the right to charge the above fees.
Use of property
All Beachside Breaks properties are for private use only, unless otherwise agreed with us in writing at the time of booking. Your property is to be maintained and left in a clean and tidy condition and the keys are to be left in the agreed position upon departure. Guests agree to take good care of the property and leave it in as good condition as it was upon arrival. There is a cleaning fee included in your total. All rubbish should be removed when departing the property, BBQ and oven left clean, all dishes washed and put away. Failure to leave the property in this condition may result in extra cleaning charges being taken from your security bond without prior notice. Use of any fireplaces is strictly prohibited without prior written agreement. Garbage disposal is the guest’s responsibility. Garbage procedures are outlined in the house manual. Guests are asked to recycle and minimize waste where possible. Excess garbage must not be left on the property or in any common/public areas. If excess garbage removal is required, a charge of $100 will be taken from your security bond without prior notice.
Pets are only welcome in pet friendly properties. Please enquire if you would like to bring your pet. There is no smoking at any property. Guests may smoke in public areas; in strata buildings this may not include balconies and common areas of the buildings. We reserve the right to withhold your bond if smoking has occurred on the property terminate your right to use the property if smoking is of a fire/safety concern. Number of guests should not exceed the number stated on the booking or subsequently agreed in writing or email. If guests accommodate more than the agreed number of occupants this may result in a partial or full loss of bond. The pool (if applicable) is used at your own risk. It is not to be used between the hours of 10pm and 8am or as per relevant bylaws or notices displayed, no glassware is permitted in the pool area. Strictly no parties are allowed:. Disturbance to neighbours, including excessive noise or offensive behavior especially between 10pm and 7am is
prohibited. Any complaints either to the Owners Corporation, property manager, neighbors or the Police may result in termination of right to the property with no refund and loss of bond. If owners or authorities should be called out to property for noise or other disturbance by guests $300 will be taken from security deposit.
You accept responsibility for any damage, breakages or theft on/to the property, its fixtures, furniture or contents, equipment or fittings, common property caused by you, your guests or other people you invited to the property. If any accidental, intentional damage deemed as negligence occurs during your stay, all costs to repair the property to the state it was prior to the damage caused will be undertaken by us at your cost. Any further costs associated with a moving guest due to arrive at the property that cannot occupy the property due to the damage caused by you will be at your cost. We also reserve the right to file a malicious damage report to the authorities if deemed appropriate. Negligence is defined as failure to give care or attention when not doing so could cause harm or foreseeable damage. If a guest identifies any risk associated with the property they are to bring this to the attention of the Beachside Breaks immediately and the issue will resolved as quickly as possible. If you damage something in the property or contents, this is to be reported to us immediately and full payment is to be made for it. On inspection after departure, security bond will be held and used to the amount of the total damage.
Guests must comply with all parking regulations. Use of the car park must be agreed with us prior, Consideration must also be shown for neighbours and other vehicles. Guests agree to follow visitor-parking rules posted by strata in the building.
We recommend guests take out travel insurance to cover cancellation costs, medical expenses, personal belongings and other travel related expense during their stay. Please read the terms and conditions of your policy to ensure the proper policy is in place.
We take no responsibility for your personal property in regards to damage or loss, regardless of where the loss or damage occurred. Your monies, valuables, goods and vehicles belong to you and will remain your responsibility at all times while brought onto the premises or its grounds. The apartment and position will be described to you by our staff or via our website or email to the best of our ability, although this information may change without notice,. The description of the property is made in good faith although we take no responsibility for errors or omissions. All photos of the property are an accurate representation of the property at the time of the photograph, although may be subject to change with fair wear and tear, change in ownership, refurbishing or other circumstances outside of our control. Nor the owner or us accept personal responsibility for personal perceptions. If any feature or facility Is essential for the guest in choosing a particular property, it is advisable you confirm this at the time of booking. We do not accept responsibility for errors or omissions, whether temporary or permanent, in regards to a properties services and facilities. All of Beachside Breaks properties are privately owned and are provided on a fully self-contained basis, unless otherwise agreed. In the event of a fault or malfunction of an inclusion or appliance, we do not have an obligation to compensate or discount however we will endeavor to be fair and ethical and will review on a case by case basis. We accept no responsibility for any inconvenience caused by machinery or appliance break down and/or missing parts. In this case we will undertake our best endeavors to repair, replace or hire an alternative wherever possible and reasonable. The owner of the property will be notified and we will seek and act on their instructions. Beachside Breaks accepts no responsibility for any common property features out of our control not being available during your stay. This includes but is not limited to, elevators, pools, BBQ’s, and car parking facilities. We will endeavor to inform you as soon as we receive notice of change in common property features. Properties may be reallocated if the management deems it necessary and a property of the same or better quality will be substituted. We will make every effort to ensure the property is available for the dates agreed. However, we reserve the right to make alterations to bookings or supply an alternative property before or during your stay for any reason due to unforeseen circumstances including but not limited to, limited availability, owner requirements or change in ownership, or any circumstance out of our and the owners control. The owner reserves the right to cancel a booking at any time. You will be notified in writing if a pre-booked property becomes unavailable, however we cannot guarantee an alternative property at the same standard as the booked one. Upon a property being listed for sale, or sold our right to act as manager is ceased, we cannot accept responsibility however we will endeavor to be of best service to you and resolve or complications that may arise. Whilst every effort is made to have the property, and appliances in good working order and condition, prior to arrival, sometimes things may be overlooked, in which case we request you to immediately advise Beachside Breaks, so that we are given the opportunity to rectify the situation. Refunds may be considered on departure. The landlord or his Agent is allowed to enter and view the state of the apartment you let at any time with prior written notice. In the event that the premises have been or are being sold prior to the commencement of you stay, we will endeavor the find alternative accommodation or we will refund all deposits in full. We accept no responsibility for guest’s personal property or injuries that may occur to you or your guests while occupying the property. You shall indemnify Beachside Breaks against all loss, injury or damage occasioned by the use, misuse or abuse of any part of the property or against any omission, neglect or default of the guests (or others), licensee’s or invitees.
If Wi-fi is offered, the service is not to be used to make offensive or nuisance communications in whatever form. Such usage includes posting, transmitting, uploading, downloading or
otherwise facilitating any content that is unlawful, defamatory, threatening, a nuisance, obscene, hateful, abusive, harmful (including but not limited to viruses, corrupted files, or any other similar software or programs), a breach of privacy, or which is otherwise objectionable. Wifi is not to be for anything unlawful, immoral or improper. Any misuse of the Wi-fi may result in partial or full loss of bond. We cannot accept responsibility of Internet or equipment failure/limitation, although will endeavor to solve any issues that arise.
If booking is completed using visa or master card, a merchant fee will be be applied, this will be clearly laid out at time of booking. The online merchant facility that is used on our website is located in Australia.
Complaint and dispute resolution
Any complaints are to be addressed to us in writing; Beachside Breaks will endeavor to settle the complaint/dispute within 48 hours. Any monies associated with our litigation, travel, and appearance costs will be at your cost if the tribunal favours Beachside Breaks.
Additional charges without prior notice may apply if you do not adhere the house rules provided on arrival or to any of the above conditions.
